The Supreme Court of India has issued a notice on a petition seeking accountability measures following the sinking of the container vessel MSC Elsa 3, which went down in the Gulf of Kachchh waters in the Arabian Sea in late December 2023. A bench headed by Justice K.V. Viswanathan sought a response from Elsa 3 Maritime Inc., the Panama-flagged company that owned the vessel, along with the Union government and relevant maritime authorities.
The MSC Elsa 3, a large container cargo ship, was en route from JNPT in Mumbai to Colombo when it caught fire and subsequently sank. The incident sent shockwaves through India's maritime community, as the vessel carried a multinational crew and raised serious concerns about marine safety, emergency preparedness, and the welfare of seafarers deployed on commercial vessels.
The disaster came at a time when India has one of the largest merchant fleets in the world and over 150,000 Indian seafarers are employed on ships across the globe. The sinking triggered a major rescue operation led by the Indian Coast Guard, and several Indian sailors were rescued from the freezing waters before the vessel finally slipped beneath the surface. However, the incident also raised uncomfortable questions about response protocols and the safety infrastructure available to crews stranded at sea.
Petitioners before the Supreme Court argued that the incident highlighted systemic failures in monitoring and regulating vessel safety, particularly for ships carrying significant numbers of Indian crew members. They urged the Court to direct a thorough investigation into the causes of the fire, the efficiency of the rescue response, and the compensation framework available to affected sailors and their families.
The Court's notice marks the first procedural step, and the matter will be listed for further hearing once responses are filed by the concerned parties.
