The Madras High Court on Tuesday dismissed an election petition that had challenged the legislative assembly election victory of E.V. Velu, who serves as the whip of the Dravida Munnetra Kazhagam (DMK) and previously held ministerial office in the Tamil Nadu government. Justice D. Bharatha Chakravarthy passed the order after hearing arguments on applications filed by Velu seeking to have the petition struck off and rejected at the threshold.
The election petition, which had questioned the legitimacy of Velu's win from his constituency, was dismissed after the court found merit in the former minister's applications to strike off various pleadings contained in the petition. Legal experts noted that the court's decision indicated shortcomings in the grounds raised by the petitioner, leading to the case being thrown out before it could proceed to a full trial on merits.
E.V. Velu, a prominent DMK leader, had been elected to the Tamil Nadu legislative assembly and also plays a key role in the party's parliamentary operations as its whip. His position as party whip involves ensuring discipline and coordinating voting patterns among MLAs belonging to the DMK. The dismissal of the election petition clears any legal cloud over his election and allows him to continue fulfilling his legislative duties without disruption.
Under Section 83 of the Representation of the People Act, 1951, an election petition must be filed within 45 days from the date of publication of the election results. Such petitions are typically filed by defeated candidates or aggrieved voters alleging electoral malpractices, including bribery, undue influence, or irregularities in the counting process. The high court's decision to dismiss the petition at the preliminary stage is relatively uncommon and suggests that the court found the pleadings insufficient or legally untenable on their face.
